Labor and the Democrat Senators have today again defeated Government plans to confer industrial relati ons power on a newly created Federal Magistrates Court.


Shadow Minister for Industrial Relations, Arch Bevis said: “The refusal of the Senate to support such Government plans spells double trouble for Mr Reith and his industrial relations agenda.


“Earlier today the Democrats sounded the death knell for the majority of Mr Reith’s second wave laws, describing those laws as unnecessary. Those laws had also proposed to allow people to avoid the Federal Court by going to State courts. In effect the Government was saying ‘if you don’t think the Federal Court is going to give you the answer you want, try your State supreme court - but if you think they’re not on your side, then we are going to set up a new Federal Magistrates Court to handle these issues’.


“Last Tuesday the Senate rejected plans to include industrial relations jurisdiction in the new Federal Magistrates Court. The Government again failed in their attempt to have the Senate pass those laws.


“It seems that Mr Reith may have to rethink his biased, unfair and divisive industrial relations laws in light of the humiliating defeat his proposed laws are subject to in the Senate,” said Mr Bevis.
