REPORT ON WILLIE BRIGITTE FLAWED

Attorney-General Philip Ruddock said that newspaper reports on a challenge in France to the ‘extradition’ of terror suspect Willie Brigitte were flawed.

Mr Brigitte was not extradited from Australia.

His visa was cancelled after he was found working in contravention of the conditions of that visa.

As a consequence Mr Brigitte was removed from Australia, under Australian law, as an unlawful non-citizen.

It is normal practice that a person being removed from Australia is sent back to their country of nationality. This does not require an application from the receiving country.

Any challenge in France to Mr Brigitte’s ongoing detention is a matter for French law.
