Senator CHATAWAY (Queensland) . - This clause seems to impose a penalty of £20 against the Minister. It is a most unusual thing to make a penalty against a Minister of the Crown.

Senator Pearce - Read sub-clause 2.

Senator CHATAWAY - It imposes a penalty upon a person because he does not apply for money.

Senator Guthrie - Yes.

Senator CHATAWAY - Am I to understand that a penalty is imposed on a person who does not apply for a sum of money which may be due to him?

Senator Guthrie - No.

Senator CHATAWAY - Otherwise the penalty must be imposed on the Minister. I ask Senator Pearce to look at the provision.

Senator Vardon -A penalty is imposed on a man if he misapplies money.

Senator CHATAWAY - According to the Acts Interpretation Act the penalty at the end of a section applies to every person covered by the section. It seems to me that this, clause imposes a penalty on the Minister, and that is a provision which ought not to be made.
