1. Meeting of Senate.—The Senate met at half-past three p.m.—The President (Senator the Honorable A. M. McMullin) took the Chair. .

4. Papers.—The following Papers were presented, by Command of His Excellency the Governor-General— Nauru—Ordinances—1953— .

5. Joint Committee of Public Accounts—Report.—Senator Paltridge brought up the following Report from the Joint Committee of Public Accounts :— Seventh Report—Administration of Sales Tax.

6. Australian Senate P ractice—P aper.—The President laid on the Table the following Paper : — “ Australian Senate Practice ” : Manuscript of a book by J. R. Odgers. The Minister for Trade and Customs (Senator O’Sullivan) moved—That the Paper be printed. Debate ensued.

Question—put and passed.

7. Postponements.—Ordered—That Orders of the Day Nos. 1 to 10, inclusive, Government Business, be postponed until after the consideration of Order of the Day No. 11.

8. International Wheat Agreement Bill 1953.—Message from the House of Representatives.—The following Message from the House of Representatives was received and read :— · Mr. P resident, Message No. 248.

The House of Representatives transmits to the Senate a Bill intituled “ A Bill for an Act to approve Acceptance by Australia of the Agreement Revising and Renewing the International Wheat Agreement ”, in which it desires the concurrence of the Senate.

Suspension of Standing Orders.—The Minister for Trade and Customs (Senator O’Sullivan), pursuant to contingent notice, moved—That so much of the Standing Orders be suspended as would prevent the Bill being passed through all its stages without delay. Question—put and passed. On the motion of the Minister for Shipping and Transport (Senator McLeay) the Bill was read a first

time.

Senator McLeay moved—That the Bill be now read a second time. On the motion of Senator Sheehan the debate was adjourned. Ordered—That the resumption of the debate be an Order of the Day for a later hour of the day.

10. I nternational Wheat Agreement Bill 1953.—Order of the Day read for the adjourned debate on the Question—That the Bill be now read a second time. ·

11. Suspension of Standing Order No. 68.—The Minister for Shipping and Transport (Senator McLeay) moved—That Standing Order No. 68 be suspended for this sitting, to enable new Business to be commenced after half-past ten o’clock at night. Question—put and passed, there being present an absolute majority of the whole number of Senators,

and no dissentient voice. ■

12. Standing Orders Committee—F irst R eport.—Order of the Day read for the consideration of the First Report of the Standing Orders Committee. · The Minister for Shipping and Transport (Senator McLeay) moved, by leave—That the Report from the Standing Orders Committee, presented to the Senate on the 16th October, 1953, be adopted. Question—put and passed.

13. P ostponements.—Ordered—That Orders of the Day Nos. 2 to 7, inclusive, Government Business, be . postponed until after the consideration of Orders of the Day Nos. 8 and 9.

14. I ncome Tax and Social Services Contribution Assessment Bill (No. 2) 1953.—Order of the Day read for the adjourned debate on the Question—That the Bill be now read a second time. Debate resumed. Question—put and passed. Bill read a second time.

Clause 3 read— Senator McKenna moved an amendment, viz.—after paragraph (e) of sub-clause (1.), insert the following paragraph :— ,

“ (/) by adding the following new sub-sections :— (5) From the value of the estate of a person who is or has been a member of the naval, military or air forces of the Commonwealth and who during service as such member or within three years of the termination of such service dies as a result of

injuries received or disease contracted during such service, there shall be deducted in respect of such part of the estate as passes to the widow, children, grandchildren, parents, brothers, sisters, nephews or nieces of the deceased a sum of Five Thousand Pounds or where the value of that part is less than Five Thousand

Pounds, an amount equal to the value of that part. 1 (6) Subject to sub-section (3.) the question as to whether a person has or has not died as a result of injuries received or disease contracted on service as a member of the naval, military or air forces of the Commonwealth may on the application of the

legal personal representatives of such person or a person beneficially interested in his estate be determined by a Judge of the Supreme Court of a State or Territory and the Supreme Court of a State is vested with Federal jurisdiction for the purposes of determining the question.”. Line 1, after “ amended ”, insert “—(a) ”. Line 25, at end of sub-clause (1.) add the following :— “ ; and (b) by adding at the end thereof the following sub-section :— ‘ (3.) In this section, “ widow ” includes widower.’.”.

Clause 4, as amended, agreed to. ,
