JOURNALS OF THE SENATE.
T U E S D A Y , 1st J U L Y , 1941.
1. Meeting ok Senate.- The Senate met at three p.m., pursuant to adjournment.
2. Approach of the Governor-General.—The approach of His Excellency the Governor-General was announced by the Usher of the Black Rod. His Excellency, having entered the Chamber . and being seated, informed Senators he was present, to administer to newly-elected Senators the . Oath or Affirmation of Allegiance as required by Section 42 of the Constitution.
3. New Senators—Certificates of E lection.—The Clerk produced and laid on the Table the Certificates of Return for the following Members elected, on 21st September, 1940, to serve in the Senate as Senators for their respective States - . New Sout.h Wales—
William Patrick Ashley, James Jarvist, Arnold, William James Large. ' 1
Queensland— Walter Jackson Cooper, Thomas William Crawford, Hat,til Spencer Foil.
South Australia — James McLachlan, George McLcay, Oliver Uppill. Tasmania—
Herbert Hays, John Blyth Hayes, Burford Sampson.
Victoria— Charles Henry Brand, William Geriand Gibson, John William Leckie.
Western A ustralm— Herbert Brayley Collett, Edward Bertram Johnston, Allan Nicoll MacDonald. .
And thereupon the before-mentioned Senators (with the exception of Senator Allan MacDonald who was not present) made and subscribed the Oath of Allegiance as provided under the Commonwealth of Australia, Constitution Act.
His Excellency then retired.
4. Election of President.—The Minister for Supply and Development (Senator MeLea.y), addressing the Clerk of the Senate by name, reminded the Senate that the time had now come when it was necessary for the Senate to choose one of its Members to be President— Whereupon Senator McLeay moved—That, Senator .John Blyth Hayes do take the Chair of this
Senate as President— Which motion was seconded by the Minister for the Interior (Senator Foil). Senator Ceilings moved—That, Senator James Cunningham do take the Chair of tliis Senate as President— Which motion was seconded by Senator Arnold. And Senators J. B. Hayes and Cunningham having submitted themselves to the Senate - The Senate thereupon proceeded t,o ballot ; and the ballot being concluded, the Clerk reported the
. result, as follows Senator J. B. Hayes .. .. .. .. . . 1 7 votes.
Senator Cunningham .. .. .. .. . . 1 7 votes.
And the votes being equal, the Senate proceeded to a second ballot,: and such ballot· being concluded, the Clerk reported the result, as follows :— Senator J. B. Hayes . . . . . . . . .. 17 votes.
Senator Cunningham . . . . . . . . . . 17 votes.
And the votes being again equal — The Clerk stated that the matter would be decided by lot, in accordance with Standing Order No. 22. The Clerk placed the names of Senators J. B. Hayes and Cunningham in a box, and drew the name of Senator J. B. Hayes as the one to be withdrawn.
Senator Cunningham was thereupon declared elected President, of the Senate.

The President-elect., having been conducted to the dais, expressed his thanks to the Senate for the honour conferred upon him, and took the Chair— Whereupon the .President was congratulated by the Leader of the Government in the Senate (Senator McLenv), the Leader of the Opposition (Senator Ceilings), and Senators E. B. Johnston, Courtice,
J. B. Hayes, Fraser, and Clothier. Senator McLeav acquainted the Senate that· 11 is Excellency the Governor-General would receive the President forthwith in the President’s Room.
The sitting of the Senate was thereupon suspended, and the President, accompanied by Senators, proceeded to the President’s Room.
⢠The Senate having resumed, the President reported that he had presented himself as the Choice of the Senate to His Excellency the Governor-General, who had been pleased to congratulate him upon his appointment as President.
5. PRAYERS.
.6. Death or Mr. J ohn Lynch. —The Minister for Supply and Development (Senator McLcay), by leave, moved -That the Senate expresses its deep regret at the death of Mr. John Lynch, a former Member of the House of Representatives for the Division of Werriwu, places on record its appreciation of his meritorious public service, and tenders its sincere sympathy to his relatives in their bereavement. And the motion having been seconded by the Leader of the Opposition (Senator Collings), and
supported by Senator Gibson And all Senators present having risen, in silence— Question—passed.
7. Supply Bill (No. 1) 1941-42.—Govern or-General's Message.—The following Message from His Excellency the Governor-General was presented, and the same was read by the President : — GOWRJE, . Governor-General. Message No. 13.
A Proposed Law intituled “ Supply Act (No. 1) 1941 -42 ”, as finally passed by the Senate and the House of Representatives of the Commonwealth, having been presented to the Governor- General for the Royal Assent, His Excellency has, in the name and on behalf of His Majesty, assented to the said Law.

10. Election or Chairman of Committees. The Minister for Supply and Development (Senator McLeav) moved That the Senate do now proceed to elect, a Chairman of Committees. Question- put. and passed. Senator McLeav moved—That Senator Walter Jackson Cooper be appointed Chairman of Committees- -
Which motion was seconded by the Minister for the Interior (Senator Foil). ' Senator Collings moved—That Senator Gordon Brown be appointed Chairman of Committees - Which motion was seconded by Senator Large. And thereupon the Senate proceeded to ballot ; and the ballot being concluded, the President, reported
the result, as follows Senat,or Cooper .. .. .. .. .. . . 1 7 votes.
Senator Brown . . . . . . . . . . . . 17 votes.
And the votes being equal, the Senate proceeded to a second ballot : and such ballot being concluded, the President, reported the result, as follows :— Senator Cooper . . . . . . . . . . . . 17 votes.

The Clerk, by direction of the President, placed the names of Senators Cooper and Brown in a box, and drew the name of Senator Cooper as the one to be withdrawn. Senator Brown was thereupon declared elected Chairman of Committees.
11. F lax I ndustry—J oint Select Committee.—Order of the Day read for the adjourned debate on the motion by Senator Aylctt, viz. .— (1) That a Joint Select Committee of the Parliament be appointed to inquire into and report upon all matters relating to—
(a) the growing and processing of 11 ax ; (b) the composition, functions and operations of the Flax Board. (2) That three members of the Senate and four members of the House of Representatives be appointed to serve on such Committee. (3) That the Committee be empowered to send for persons, papers and records, to move from place
to place, and to sit during the adjournment of Parliament. (4) That a message be sent to the Mouse of Representatives requesting its concurrence and asking that four members be appointed to serve on such Committee. Debate resumed. Question—put. The Senate divided—
