Senator BOLKUS (Minister for Immigration and Ethnic Affairs and Minister Assisting the Prime Minister for Multicultural Affairs) —In my capacity as the Minister representing the Attorney-General, I wish to respond to two questions on notice asked by Senator Chapman. In respect of question No. 2094, I believe an interim answer was lodged with the Clerk of the Senate today.

  In respect of question No. 2053—which asked upon whose recommendation Chief Justice Underhill had been appointed to the Queensland Family Court and what selection process was used to make this appointment—the Attorney-General has provided the following answer:

(1)I am advised that Justice Peter Underhill of the Family Court of Australia was appointed to that position with effect from 31 January 1978 by the Governor-General on the advice of the Federal Executive Council following the Fraser Cabinet endorsement of a recommendation to that effect from Senator the Hon. Peter Durack, Attorney-General.

(2)I am advised that the process was in accordance with the requirement for appointment of judges which is set out in section 22 of the Family Law Act 1975. I am further advised that a number of other distinguished persons were consulted prior to the recommendation being made.
