Estimates Committee A Report to the Senate

ESTIMATES COMMITTEE A

REPORT TO THE SENATE

Estimates Committee A has the honour to report to the Senate.

1. On 4 May 1983, the Senate referred to the Committee the Particulars of Proposed Additional Expenditure for the year 1982-83, and the Vote contained in the Schedule to Appropriation Act (No. 3) 1982-83, relating to the Departments of Indus­ try and Commerce, Prime Minister and Cabinet, Employment and Industrial Re­ lations, and Communications. The Committee noted that when, on 4 May 1983, the

motion was moved to refer the Estimates to all Estimates Committees the Attorney- General indicated that there were no items within the particulars of the proposed ad­ ditional expenditure for the four parliamentary departments which this Committee normally examines. He sought the agreement of the Senate to the proposal not to refer

the particulars and, as a result of the Senate’s concurrence, Estimates Committee A was not required to examine Parliament.

2. The Committee has considered the Estimates of the Departments, together with the Departmental Explanatory Notes, and has received evidence in relation to them from the Leader of the Government and Minister for Industry and Commerce (Senator the Honourable John Button) and officers of the Departments concerned. Copies of the

Minutes of Proceedings and Hansard reports of the evidence taken by the Committee are tabled for the information of the Senate in connection with Appropriation Bill (No. 5) 1982-83 and Appropriation Bill (No. 6) 1982-83. Answers to questions which were deferred and subsequently given in writing since the Committee’s last hearings will be

tabled in the Senate and incorporated in the final Hansard report of the Committee’s hearings.

3. The Committee draws the attention of the Senate to the following matters aris­ ing from its consideration of the Estimates:

Subsidiaries of Statutory Authorities During examination of the Auditor-General’s comments, in his September 1982 and May 1983 reports, on the operations of the Australian Industry Development Corpor­ ation, members of the Committee drew attention to concerns previously expressed by the Senate Standing Committee on Finance and Government Operations about the cre­ ation of subsidiaries by statutory authorities, particularly subsidiaries which have power beyond the powers of the statutory authorities themselves.

The Minister for Industry and Commerce indicated that a review of AIDC legis­ lation would be undertaken, and that the matters referred to would be taken into account. He further stated that the general question of subsidiaries of all statutory authorities would be considered by the Government in due course.

The Committee urges the Government to ensure that, when it considers the appro­ priate steps to be taken, consideration not be confined to the matter of a power of a statutory authority to create subsidiaries, but be extended so that, in the event that authorities are given such a power in the legislation which creates them, there be ad­ equate provision for the Parliament to be advised at the time when any subsidiary is

being created by any statutory authority.

Form of Explanatory Notes During its examination of the Estimates for the Department of Industry and Com­ merce, the Committee noted that, despite the fact that certain Advisory Councils had been transferred from the Department of Industry and Commerce, resulting in a re­

duction of councils the Department was required to service from eleven advisory coun­ cils to eight or nine, additional estimates were sought for the provision of services to the

revised number of councils. The Committee was unable to ascertain from the Explana­ tory Notes the amount saved by the Department as a result of the transfer, and why ad­ ditional expenditure was needed to service the councils.

Previous Committees have, over a long period, had cause to comment on the diffi­ culties involved in reconciling estimates before them with estimates before other Com­ mittees resulting from transfers of administrative functions. Further, they have sought Explanatory Notes which cross-reference information on specific programs with expenditure spread over a number of appropriation items within each department. In the case of the Department of Industry and Commerce, the required information has been sought as additional information for this Committee.

Estimates Committee A urges the Department, and other departments, to provide the information sought in the future. In this context, the Committee compliments the Department of Employment and Industrial Relations for its most helpful paper, laid before the Committee, which gave details of the specific programs covered by a number of appropriation items.

4. The Committee expresses its appreciation of the assistance given by the Leader of the Government and Minister for Industry and Commerce, and the officers of the various departments and authorities who appeared before the Committee.

3. ELECTION OF CHAIRMAN: The Secretary then called for nominations for Chairman. Senator Robert Ray was nominated by Senator Peter Rae. There being no further nominations, Senator Robert Ray was declared elected and thereupon took the Chair.

Vote contained in the Schedule to Appropriation Act (No. 3) 1982-83 for the following departments:

Aboriginal Affairs 2. The Committee has considered the Proposed Additional Expenditure and has received explanations from the Minister and officers representing the Departments concerned. Copies of the Minutes of Proceedings and Hansard reports of the evidence

taken by the Committee in connection with the Appropriation Bills (Nos 5 and 6) 1982-83 are tabled for the information of the Senate. Certain answers to questions which were deferred and subsequently given in writing since the Committee’s hearing will be tabled in the Senate and incorporated in the final Hansard report of the Com­ mittee’s hearings.

3. Although the Committee found no item of particular concern in its consideration of the Additional Estimates for 1982-83, the Committee draws the attention of the Senate to the following matter relating to the organisation of Estimates Committees.

Notwithstanding the difficulties arising from the recent changes in Government and Administrative Arrangements, the Committee considers that the Estimates review function of the Senate would benefit from a more permanent arrangement of both Committee composition and staff and recommends that the Committee Review Group

Discussion Paper on ‘The Structure of the Senate’s Committee System’ (approved 4 May 1982) be further considered by the Senate.
