US Court Ruling Makes Farce of Ruddock Bill

1st Feb 05

The US court ruling that invalidates the Military Commission set up to try Guantanamo Bay inmates, makes a farce of Australian law recognising the commission, Greens Senator Bob Brown said today.

“Attorney General Philip Ruddock’s International Transfer of Prisoners Amendment Act 2004 passed last March with the support of Labor, specifically recognises the Military Commission as a court of the USA,” Senator Brown said.

“The US court ruling which discredits military commissions does not effect the Ruddock bill.

“Mr Ruddock, backed by Labor, has left Australia in the goofy situation where we recognise a US kangaroo court which the US constitution prohibits.

“It shows the absurdity of the Howard government’s kowtowing to the Bush administration - even when it breaches the US constitution.

“The Ruddock act should be repealed immediately,” Senator Brown said.
