Same Sex Marriage Push A Political Stunt

The Greens and gay lobby push for same sex marriage is a political stunt to gain publicity, Senator Guy Barnett said today.

“They know they cannot change the Federal legislation which confirms marriage as between a man and a woman. Their attempt to circumvent the Federal law, via the states, is a futile distraction from the major issues confronting Australians,” Senator Barnett said.

“In the Federal election last October more than 85% of the population supported the actions taken in Parliament earlier in the year to enshrine marriage as being between a man and a woman.

“The gay lobby should listen to the people and give up on their mischievous endeavours,” Senator Barnett said.

He said there was no loophole in the Australian Government’s reforms last year to the Marriage Act and no action by State Parliaments could change the Federal law.

“Section 51 of the Australian Constitution gives the Australian Government power to make laws with regard to marriage,” Senator Barnett said.

He said that Section 109 of the Constitution provides that where there is an inconsistency between Federal and State law the State law is invalidated and Federal law prevails.

Last year Senator Barnett spearheaded the push nationally to reform the Marriage Act to define marriage as between a man and a woman.
