Minister for Ageing MEDIA RELEASE

Belvedere Park Nursing Home Revocation - AAT decision

August 8, 2008

The Minister for Ageing, Mrs Justine Elliot welcomed the decision by the Administrative Appeals Tribunal (AAT) to affirm the Department of Health and Ageing’s revocation of official approved provider status for a Melbourne nursing home operator which failed a record 42 out of 44 care categories.

Under the previous government, the Department of Health and Ageing imposed sanctions in August 2007 on Saitta Pty Ltd, the Approved Provider of the former Belvedere Park Nursing Home.

This action resulted in the revocation of their approval as a provider of aged care services. However, Saitta Pty Ltd appealed to the AAT to have the sanctions overturned.

The Department strongly defended its actions against Saitta Pty Ltd saying it had failed to provide good quality care.

Earlier this week (August 5), the AAT affirmed the Department’s decision on Belvedere Park Nursing Home.

“The Tribunal’s decision is testament to the commitment of Departmental staff and the need to put the care and safety of residents’ first,” Mrs Elliot said.

“I am pleased this sorry situation has come to an end.”

Belvedere Park closed on September 21, 2007 and all 25 former residents were re-located to other nursing homes.
