The Minister for the Interior,Mr Peter Nixon, said

today that penalties imposed by the court in the Australian

Capital Territory could only be remitted by the Governor

General on the advice of the Attorney General.

He was commenting on a judgment by Mr Justice

Smnithers in the A.C.T.Supreme Court yesterday who upheld an

appeal against a prosecution under the Water (restriction of

use) Ordinance.

Mr Nixon said any ;Jerson affected by this judgment

who wanted to seek a remission of the penalty could make formal

ap_•)lication either directly to the Attorney General or to the

Secretary of the Attorney General's Department,
