in the Federal Court against Simsmetal Limited and two of its senior employees alleging attempted market sharing and misuse of market power in the South Australian steel scrap market.

The ACCC alleged that during 1995 an employee of Simsmetal attempted on two occasions to make an anticompetitive arrangement with one of Simsmetai's competitors in South Australia. One of the principal provisions of the attempted arrangement was that Simsmetal and the competitor would not compete for each . other’s clients. The ACCC further alleges that after these attempts failed, Simsmetal then used its market power to punish the competitor by targeting its two major clients.

A directions hearing has been set down for 9.30am on 12 March 1998 in the Federal Court, Canberra.
