HELP FOR SMALL BUSINESS ON LEGAL ISSUES

Legal issues are part and parcel of small business operations. A good understanding of legal matters will enable small business managers to manage better, consult legal advisers when needed and to work in partnership with them.

Two new information publications to assist small business are now available from my department. They should be a valuable resource in raising the awareness among small business managers of legal matters that impact on their day-to-day activities.

Legal Issues Guide and Training Program for Small Business is an Internet-based publication with more than 1000 links to Commonwealth, State, Territory and local government sites for further information and assistance on legal issues.

This guide will be especially useful to small business advisers. Small business advisers are better able to help if they have a broad appreciation of legal issues that affect small business and are equipped with information that will assist their clients to better understand the nature of the legal issues that impinge on their operations.

Working with Contracts - Practical Assistance to Small Business Managers will familiarise small business managers with contracts - what they are, what they contain and how to avoid the pitfalls.

Working with Contracts will give small business managers the ability to use contracts confidently and help them get the most from these very valuable and fundamentally important business tools.

These two information items have been developed under the Government’s New Deal: Fair Deal package of fair trading reforms originally announced in September 1997.

The guides are not intended to tell small business everything there is to know about legal issues and do not replace the need for professional legal advice.

LAUNCH OF WORKING WITH CONTRA CTS - PRA CTICAL ASSISTANCE TO SMALL BUSINESS MANAGERS AND LEGAL ISSUES GUIDE FOR SMALL BUSINESS

• The Working with Contracts guide and Legal Issues Guide and Training Program have been developed under the New Deal: Fair Deal - Giving Small Business a Fair Go package of fair trading reforms announced by the Government in September 1997.

• In New Deal: Fair Deal the Government delivered a significant package of fair trading reforms for the benefit of small businesses.

• One of the key features of New Deal: Fair Deal was funding for a small business education program to, among other things, raise small business awareness of legal obligations. In particular, New Deal: Fair Deal identified that there was not enough information available on risks for small business, especially in relation to working with contracts.

• Working with Contracts - Practical Assistance to Small Business Managers aims to ; empower small business managers to use contracts confidently and appropriately as a commercial tool by: - increasing small business managers’ understanding of contractual rights and

obligations; - providing guidance on what to look out for in negotiating specific types of contracts; and - encouraging small business managers to work in partnership with their legal advisers

in negotiating contracts.

• The Working with Contracts guide is available at Auslnfo outlets for a cost of $10 and on the Internet at www.dewrsb.gov.au/contractsguide

• The Legal Issues Guide and Training Program fo r Small Business aims to increase small business managers and advisers’ awareness and understanding of: - the nature of legal problems impacting on small business; - the range of options available to small business managers to handle the problem; and

- preventative measures to avoid the problem arising again in the future, where possible.

• "The Internet-based Legal Issues guide links to more than 1,000 Commonwealth, State, Territory and local government sites for further information and assistance.

• The Legal Issues guide can be accessed on the Internet at legalissues.dewrsb.gov.au

• A one-day training program has also been developed specifically for small business advisers. It will assist business advisers to improve the quality of assistance provided to small business managers with legal problems affecting their business. The guide will be introduced in the training program as a resource for advisers.
