A Bill for an Act to impose, as taxes, charges in relation to the Foreign Influence Transparency Scheme, and for related purposes

The Parliament of Australia enacts:

1   Short title

                   This Act is the Foreign Influence Transparency Scheme (Charges Imposition) Act 2017 .

2   Commencement

             (1)  Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

1.  The whole of this Act

At the same time as the Foreign Influence Transparency Scheme Act 2017 commences.

 

Note:          This table relates only to the provisions of this Act as originally enacted. It will not be amended to deal with any later amendments of this Act.

             (2)  Any information in column 3 of the table is not part of this Act. Information may be inserted in this column, or information in it may be edited, in any published version of this Act.

3   Extension to external Territories

                   This Act extends to every external Territory.

4   Extraterritoriality

                   This Act applies both within and outside Australia.

5   Imposition of charges

                   Charges payable in accordance with subsection 63(1) of the Foreign Influence Transparency Scheme Act 2017 are imposed.

6   Amount of charges

             (1)  The amount of the charge payable is the amount prescribed by the regulations.

             (2)  Without limiting subsection (1), the regulations may do any or all of the following:

                     (a)  prescribe an amount or a method for working out an amount;

                     (b)  prescribe different amounts or methods for different circumstances;

                     (c)  prescribe a nil amount for prescribed circumstances.

             (3)  The prescribed amount of a charge does not need to bear any relationship to the cost of providing any services in connection with the matter for which the charge is payable.

7   Regulations

                   The Governor-General may make regulations prescribing matters:

                     (a)  required or permitted by this Act to be prescribed by the regulations; or

                     (b)  necessary or convenient to be prescribed for carrying out or giving effect to this Act.
