A Bill for an Act to amend the Marriage Act 1961, and for related purposes

The Parliament of Australia enacts:

1   Short title

                   This Act may be cited as the Marriage Amendment Act 2001 .

2   Commencement

             (1)  Sections 1, 2 and 3 commence on the day on which this Act receives the Royal Assent.

             (2)  Subject to subsection (3), the items of Schedule 1 (other than items 19 and 20) commence on a day or days to be fixed by Proclamation.

             (3)  If an item to which subsection (2) applies does not commence under that subsection within the period of 12 months beginning on the day on which this Act receives the Royal Assent, the item commences on the first day after the end of that period.

             (4)  If item 371 of Schedule 1 to the Administrative Review Tribunal (Consequential and Transitional Provisions) Act 2001 has not commenced before the commencement of section 1 of this Act, items 19 and 20 of Schedule 1 to this Act commence immediately after the commencement of item 371 of Schedule 1 to the Administrative Review Tribunal (Consequential and Transitional Provisions) Act 2001 .

             (5)  If item 371 of Schedule 1 to the Administrative Review Tribunal (Consequential and Transitional Provisions) Act 2001 has commenced before the commencement of section 1 of this Act, items 19 and 20 of Schedule 1 to this Act commence immediately after the commencement of item 18 of Schedule 1 to this Act.

             (6)  The items of Schedule 2 (other than item 15) commence on the 28th day after the day on which this Act receives the Royal Assent.

             (7)  Subject to subsection (8), item 15 of Schedule 2 commences on a day to be fixed by Proclamation.

             (8)  If item 15 of Schedule 2 does not commence under subsection (7) within the period of 6 months beginning on the day on which this Act receives the Royal Assent, that item commences on the first day after the end of that period.

3   Schedule(s)

                   Subject to section 2, each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.
