Territories Stolen Generations Redress Scheme (Facilitation) Bill 2021

 

 

(1)     Clause 4, page 3 (lines 17 and 18), omit “prescribed by the regulations for the purposes of this paragraph”.

(2)     Clause 4, page 3 (lines 19 to 25), omit subclause (3), substitute:

             (3)  Without limiting subsection (1), a payment under the Territories Stolen Generations Redress Scheme is not an asset for the purpose of determining the value of a person’s assets under:

                     (a)  the Social Security Act 1991 or the Veterans’ Entitlements Act 1986 ; or

                     (b)  any other law of the Commonwealth where counting the payment as an asset would negatively impact the person’s eligibility for, or entitlement to, any pension, benefit, payment or service (however described); or

                     (c)  a law of a State or a Territory where counting the payment as an asset would negatively impact the person’s eligibility for, or entitlement to, any pension, benefit, payment or service (however described).
