Schedule 3A—National Environmental Standards

 

Environment Protection and Biodiversity Conservation Act 1999

1  After paragraph 50(a)

Insert:

                    (aa)  is consistent with the National Environmental Standards; and

2  After section 391

Insert:

391A  National Environmental Standards

             (1)  The Minister must, by legislative instrument, make National Environmental Standards.

             (2)  Without limiting subsection (1), the National Environmental Standards may make provision for, and in relation to, the following:

                     (a)  ecologically sustainable development;

                     (b)  matters of national environmental significance;

                     (c)  transparent processes and robust decisions, including community consultation;

                     (d)  adequate assessment of impact, including climate impacts on matters of national environmental significance;

                     (e)  emissions-profile disclosure;

                      (f)  Indigenous engagement and involvement in environmental decision-making;

                     (g)  data and information;

                     (h)  environmental monitoring and evaluation of outcomes;

                      (i)  restoration and recovery;

                      (j)  wildlife trade.

             (3)  The Minister must not make a decision listed in a provision of the table in subsection 391(3) unless the Minister is satisfied the decision is consistent with the National Environmental Standards.

             (4)  The regulations must prescribe a process (including consultation) that must be undertaken before a National Environmental Standard may be made under subsection (1).
