Migration Amendment (Repairing Medical Transfers) Bill 2019



(1)     Clause 2, page 2 (table item 1), omit “Sections 1 to 3”, substitute “Sections 1 to 4”.


(2)     Clause 2, page 2 (table item 2), omit the table item, substitute:

2.  Schedule 1

The day after the report mentioned in section 4 has been tabled in each House of Parliament.



(3)     Page 2 (after line 11), after clause 3, insert:

4  Physical and mental health assessments of transitory persons in regional processing countries

             (1)  The Minister must cause the Independent Health Advice Panel (the panel ) to conduct assessments of the physical and mental health of each transitory person who is in a regional processing country at the time of this section’s commencement.

             (2)  As soon as reasonably practicable after the panel has conducted the assessments, the panel must give the Minister a writt en report of the assessments.

             (3)  The report must include the following information in relation to each transitory person assessed:

                     (a)  the person’s age;

                     (b)  the person’s gender;

                     (c)  the period of time the person has been in the regional processing country;

                     (d)  the date of the assessment;

                     (e)  the assessment’s conclusion in relation to the person’s physical and mental health.

             (4)  The report must not identify the person.

             (5)  The Minister must cause a copy of the report to be tabled in each House of the Parliament within 15 sitting days of that House after the report is given to the Minister.

             (6)  An expression used in this section that is also used in the Migration Act 1958 has the same meaning as in that Act.
