Regulations: Motion to Disallow - Address to the Governor-General.

Senator Sir GEORGEPEARCE (Western Australia) [3.10]. - I move -

That Statutory Rules 1931, No. 58, Transport Workers (Waterside Workers) Regulations, be disallowed.

Senator McLachlan - I second the motion.

Senator Barnes - I rise to a point of order under Standing Order No. 133. The question to be proposed by you, sir, is the same in substance as a question already resolved in the affirmative in this session, namely, the disallowance of regulations under the Transport Workers Act, giving preference in employment to returned soldiers and members of the Waterside Workers Federation of Australia. In support of my contention as to the question being the same in substance, I refer not only to the unanimous expressions of opinion by honorable senators opposite that the regulations are substantially the same, but also to the notice of motion given yesterday by the right honorable the Leader of the Opposition, having a similar implication and, in addition, to the judgment of Mr. Justice Starke in the recent waterside workers' case.
