Mr DEAKIN - The necessity has not yet arisen. If it does arise, it will be in consequence of a judgment of the High Court, or of the Privy Council, declaring that the Constitution does not contain such a power. In my opinion, it already contains such a power, but, if it does not, it will certainly be necessary to provide a reciprocal immunity which will protect the officers of a State from the legislation of the Commonwealth and the officers of the Commonwealth from any legislation of a State.
