5 Afghanistan
Adjourned debate on the motion of the Leader of the Government in the Senate (Senator Wong), also on behalf of the Leader of the Opposition in the Senate (Senator Birmingham) and Senator Payman—That the Senate—
(a) acknowledges:
(i) 15 August 2022 marks one year since Kabul fell to the Taliban,
(ii) this date will be a particularly difficult day for many in Australia, for the families of the 41 Australian servicepeople who tragically died in Afghanistan and of those that have been lost since returning, for the more than 39,000 Australian Defence Force personnel and civilians who deployed to Afghanistan over twenty years, for Afghan-Australian communities with loved ones still in Afghanistan, for the thousands of Australian police, diplomats, officials and aid workers that contributed to our efforts there, and
(iii) our commitment to help those who assisted Australian operations in Afghanistan find safe harbour, and the continued efforts of the Australian Government and non-governmental organisations to resettle Afghans in Australia;
(b) notes:
(i) Australia remains committed to working with the international community to respond to the humanitarian needs of the people of Afghanistan, and
(ii) the Taliban, who remain in effective control of Afghanistan, have spurned the opportunity for reform, engaged in violence and repression, and systematically rolled back human rights advancements, undermined media and political freedoms, harboured terrorists and taken away the rights of women and girls;
(c) recognises:
(i) protracted, severe and deepening humanitarian, economic, security and development crises continue to have a devastating impact on the people of Afghanistan, and
(ii) the contributions made by the Afghan diaspora in Australia and that 31,500 visa places for Afghan nationals have been made available over four program years; and
(d) calls on the Taliban to:
(i) stand by its commitment to uphold the rights of all Afghans, including women, girls and minority groups, and
(ii) not allow Afghanistan to become a safe haven for terrorist organisations and their support networks ( Senator Steele-John , in continuation, 5 September 2022 ).

(1) That there be laid on the table by the Minister representing the Attorney General, by no later than 10 am on Thursday, 15 December 2022, all correspondence, emails, briefings, notes, meeting agendas and minutes, and other records of interactions between the Attorney-General or the Attorney General’s Department and New South Wales or Queensland authorities responsible for prisons since 1 January 2022 in relation to:
(a) the visit to Australia by the United Nations Subcommittee on Prevention of Torture in October 2022; or
(b) the implementation of the Optional Protocol to the Convention Against Torture.
(2) For the purposes of this order, ‘New South Wales or Queensland authorities responsible for prisons’ includes but is not limited to:
(a) ministers of the New South Wales or Queensland governments;
(b) the New South Wales Department of Communities and Justice;
(c) Corrective Services NSW;
(d) the Queensland Department of Justice and Attorney-General;
(e) Queensland Corrective Services; and
(f) individual prisons, mental health facilities or other places of detention within New South Wales or Queensland.
*102 Senator Bilyk : To move—That the Senate—
(a) notes that commemorations are underway for the 89th anniversary, and on the cusp of the 90th anniversary, of Holodomor to mark an enforced famine in Ukraine caused by the deliberate actions of Joseph Stalin’s Communist Government of the Union of Soviet Socialist Republics;
(b) recalls that it is estimated that up to seven million Ukrainians starved to death as a result of Stalin’s policies in 1932 and 1933 alone;
(c) condemns these acts aimed at destroying the national, cultural, religious and democratic aspirations of Ukrainian people;
(d) condemns all similar acts during the twentieth century as the ultimate manifestations of racial, ethnic or religious hatred and violence;
(e) honours the memory of those who suffered or lost their lives during Holodomor;
(f) joins the Australian Ukrainian community and the international community in commemorating this tragic milestone under the motto Ukraine remembers - The world acknowledges;
(g) recognises the importance of remembering and learning from such dark chapters in human history, to ensure that such acts are not repeated;
(h) pays its respects to Australian Ukrainians that lived through this tragedy and have told their horrific stories; and
(i) condemns the Russian invasion of Ukraine started on 24 February 2022, and its actions, including the withholding of grain from the international community.
*103 Senator Whish-Wilson : To move—
(1) That there be laid on the table by the Minister representing the Minister for the Environment and Water, by no later than midday on 1 December 2022, the following documents:
(a) any review conducted in 2022 of the Australian Packaging Covenant Organisation (APCO) National Packaging Targets 2025, including any draft document provided to the Minister or the Department in respect of same, or any document that pertains to any update of the collective impact report released in November 2021; and

92 Gabba stadium project—Order for production of documents—Compliance
That the Senate—
(a) notes that:
(i) order for production of documents no. 69 (the order) agreed by the Senate on 27 October 2022, requiring the Minister representing the Minister for Infrastructure, Transport, Regional Development and Local Government to table documents in relation to The Gabba Stadium project and impacts on East Brisbane State School, has not been complied with, and
(ii) the Minister for Infrastructure, Transport, Regional Development and Local Government, in their response to the order, made a claim of public interest immunity on the basis that it would damage relations between the Commonwealth and states, citing concerns that disclosure of the information would harm the Commonwealth’s ongoing relationship with a state government on this and future infrastructure arrangements;
(b) rejects the public interest immunity claim made by the Minister for Infrastructure, Transport, Regional Development and Local Government, noting that:
(i) when a claim of public interest immunity is made on the basis that it would damage relations between the Commonwealth and states, the agreement of the states to disclose the information should be sought and they should be invited to give reasons for any objection, and
(ii) no such agreement has been sought, nor has the Senate been advised of any objections from the Queensland Government, and
(iii) the public has a right to know the details of, and deliberations on, infrastructure projects such as the Gabba Stadium project and impacts on surrounding infrastructure; and
(c) requires the Minister representing the Minister for Infrastructure, Transport, Regional Development and Local Government to comply with the order by no later than midday on 29 November 2022.

*96 Family Assistance Legislation Amendment (Cheaper Child Care) Bill 2022—Modelling and analysis—Order for production of documents
That there be laid on the table by the Minister representing the Minister for Education, by no later than 2 pm on 29 November 2022, modelling and analysis that was conducted by the Department of the Treasury into the potential economic impact and increase in workforce participation resulting from the Family Assistance Legislation Amendment (Cheaper Child Care) Bill 2022 (as discussed by Department of the Treasury officials on 2 November 2022 at a public hearing of the Education and Employment Legislation Committee).

Days and hours of meeting and routine of business—Variation
That—
(1) The hours of meeting on Tuesday, 22 November and Thursday, 24 November 2022 be from midday till 9.30 pm and 9 am till 7.30 pm respectively, and the routine of business from 7.30 pm on Tuesday and from 5.30 pm on Thursday be:
(a) government business only; and
(b) adjournment without debate.
(2) Divisions may take place after 6.30 pm on Tuesday, 22 November 2022 and after 5.30 pm on Thursday, 24 November 2022.
(3) The Senate meet on Friday, 25 November and Friday, 2 December 2022.
(4) The hours of meeting on Friday, 25 November 2022 be 9 am till 4 pm, and the routine of business be as follows:
(a) government business only; and
(b) adjournment without debate.

Estimates hearings for 2022

(2) That cross portfolio estimates hearings on Indigenous matters and on Murray-Darling Basin Plan matters be scheduled for Friday, 11 November but not restricted to that day.
