Senator Woodley moved the following amendment:

Schedule 1, page 13, item 34, proposed paragraph 1299(2)(a), omit the

paragraph.

Debate ensued.

Question--That the amendment be agreed to--put and negatived.

On the motion of Senator Knowles the following amendment was debated and

agreed to:

Schedule 2, page 21, item 9, proposed subsection 12(2B), after "give the

Privacy Commissioner" insert "and cause to be laid before each House of

the Parliament".

Senator Woodley moved the following amendment:

Schedule 3, pages 25 and 26, item 2, proposed subsection 1237A(1) and

note, omit the subsection and note, substitute the following subsection:

Administrative error

" "1237A.(1) The Secretary must waive the right to recover the

proportion of a debt, the dominant cause of which can be attributed to

administrative error made by the Commonwealth, if the debtor received

in good faith the payment or payments that gave rise to that

proportion of the debt.".

Debate ensued.

Question--That the amendment be agreed to--put and negatived.

Senator Woodley moved the following amendment:

Schedule 3, page 30, item 2, proposed subsection 1237AAC(5), omit the

subsection, substitute the following subsection:

Waiver of amount equal to notional entitlement to parenting allowance

" "(5) The Secretary must waive under subsection (4) the right to

recover the amount of debt equal to the amount of parenting allowance

that would have been payable to the debtor or the debtor's partner

during the overpayment period if:

(a) the overpayments had not been made to the debtor; and

(b) the debtor or the debtor's partner had lodged a claim for the

allowance.".

Debate ensued.

Schedule 4, item 4, proposed sections 1206E and 1206F--

leave:

That the House of Representatives be requested to make the following

amendments:

Schedule 1, page 5, after item 1 insert the following item:

"1A. After subsection 1074A(1):

Insert:

"(1A) An investment in the listed Meridian Investment Trust, comprised

of units in that Trust received in exchange for units in one or more

Estate Mortgage Trusts, is deemed to be, and always to have been, a

market-linked investment that was made or acquired before 9 September

1988.'.".

Schedule 16, page 199, after item 1 insert the following item:

"1A. After subsection 46AA(1):

Insert:

"(1A) An investment in the listed Meridian Investment Trust, comprised

of units in that Trust received in exchange for units in one or more

Estate Mortgage Trusts, is deemed to be, and always to have been, a

market-linked investment that was made or acquired before 9 September

1988.'.".

Debate ensued.
