LOCAL GOVERNMENT (FINANCIAL ASSISTANCE) BILL 1995

Explanatory memorandum: The Minister for the Environment, Sport and

Territories (Senator Faulkner) tabled a supplementary explanatory

memorandum relating to the Government amendment to be moved to the bill.

On the motion of Senator Faulkner the following amendment was debated

and agreed to:

Clause 6, page 6, at end of clause, add the following subclauses:

"(6) National principles formulated under subsection (1), and

revocations or variations of national principles under subsection (4),

are disallowable instruments for the purposes of section 46A of the

Acts Interpretation Act 1901.

"(7) If there are no national principles in force under this section,

paragraph 11(2)(d) is to be read as requiring the Commission to make

the recommendations on the same basis as the basis on which the

Minister is, under subsection (2) of this section, required to act in

formulating national principles (see paragraphs (2)(a) and (b)).".

Senator Margetts moved the following amendment:

Clause 16, page 15, at end of paragraph 16(3)(c), add the following word

and subparagraph:

"; and (iii) their management of natural resources and the

environment.".

Debate ensued.

Question--That the amendment be agreed to--put and negatived.

Senator Margetts moved the following amendment:

Clause 16, page 15, subclause (4), omit the subclause, substitute the

following subclause:

"(4) The Minister must cause a copy of each report to be laid before

or supplied to, as the case may be:

(a) each House of the Parliament;

(b) the Local Government Minsters Conference; and

(c) each body representative of local government;

as soon as is practicable after the report has been prepared.".

Debate ensued.

Question--That the amendment be agreed to--put and negatived.

Bill to be reported with an amendment.

The Acting Deputy President (Senator Colston) resumed the Chair and the

Chairman of Committees (Senator Reid) reported accordingly.

On the motion of Senator Faulkner the report from the committee was

adopted and the bill read a third time.
