HUMAN SERVICES AND HEALTH LEGISLATION AMENDMENT BILL (NO. 1) 1995

Order of the day read for the further consideration of the bill in

committee of the whole.

Senator Harradine, pursuant to contingent notice, moved--That it be an

instruction to the committee of the whole that:

(a) the committee divide the Human Services and Health Legislation

Amendment Bill (No. 1) 1995 to incorporate in a separate bill

the proposed amendments to the Therapeutic Goods Act 1989; and

(b) the committee add to that bill enacting words and provisions for

titles and commencement.

Question put and passed.

Division of bill: Senator Harradine moved--

(1) That the Human Services and Health Legislation Amendment Bill (No.

1) 1995 be divided, and that the proposed amendments to the

Therapeutic Goods Act 1989 contained in items 80 to 150

(inclusive) of Schedule 1 and item 15 of Schedule 2 be

incorporated in a single Schedule of a separate bill and those

items renumbered 1 to 71 and 72, respectively.

(2) That that separate bill be amended by adding the following at the

beginning of the bill:

An Act to amend the Therapeutic Goods Act 1989

The Parliament of Australia enacts:

Short title

1. This Act may be cited as the Therapeutic Goods Amendment Act 1995.

Commencement

2.(1) Subject to this section, this Act commences on the day on which

it receives the Royal Assent.

(2) Items 19, 20, 24 and 25 of the Schedule commence on 1 July 1995.

(3) Item 38 of the Schedule commences, or is taken to have commenced,

immediately after the commencement of the Audit (Transitional and

Miscellaneous) Amendment Act 1995.

Schedule

3. The Therapeutic Goods Act 1989 is amended as set out in the

Schedule.

SCHEDULE".

(3) That subclauses 2(4) and 2(5) of the Human Services and Health

Legislation Amendment Bill (No. 1) 1995 be omitted.

The Acting Deputy President (Senator Reynolds) resumed the Chair and

the Temporary Chairman of Committees (Senator Calvert) reported that

the committee:

(a) had considered the Human Services and Health Legislation

Amendment Bill (No. 1) 1995 and, pursuant to the instruction of

the Senate, had divided the bill into two bills, the Human

Services and Health Legislation Amendment Bill (No. 1) 1995 and

the Therapeutic Goods Amendment Bill 1995; and

(b) had amended the Therapeutic Goods Amendment Bill 1995 to add

enacting words and provisions for titles and commencement.

On the motion of the Minister for Family Services (Senator Crowley) the

report from the committee was adopted and the bills read a third time.
