CONSIDERATION OF LEGISLATION

Motion determined as not formal: The Parliamentary Secretary to the

Minister for Primary Industries and Energy (Senator Sherry), at the

request of the Minister for Defence (Senator Ray), asked that Government

Business notice of motion no. 2 standing in the name of Senator Ray for

this day, relating to the consideration of the Audit (Transitional and

Miscellaneous) Amendment Bill 1995, be taken as formal.

An objection was raised and the motion was not proceeded with as a

formal motion.

Point of order: Senator Harradine raised a point of order to the effect

that, as the order of the Senate of 29 November 1994 relating to the

consideration of legislation contemplates that the Government explain

any proposed exemption of a bill from the order, it is not in order for

a motion to exempt a bill from the order to be taken as a formal motion.

Ruling of Acting Deputy President: The Acting Deputy President (Senator

McKiernan) ruled that it is in order for leave to be granted for a

motion to be moved as a formal motion even if that course is

inconsistent with an order of the Senate.

formal motion.
