STUDENT ASSISTANCE (YOUTH TRAINING ALLOWANCE--TRANSITIONAL PROVISIONS
AND CONSEQUENTIAL AMENDMENTS) BILL 1994

The following messages from the House of Representatives were reported:

MR PRESIDENT,

The House of Representatives returns to the Senate the Bill intituled

"A Bill for an Act to amend the Student Assistance Act 1973, and

acquaints the Senate that the House of Representatives has considered

the message of the Senate requesting the House to make certain

amendments in such Bill.

The House of Representatives has made requested amendments Nos. 1, 2,

3, 4, 5, 6, 7, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22

and 23; and has not made requested amendment No. 8, but in place

thereof has made the amendment as indicated by the annexed schedule.

The House of Representatives desires the reconsideration by the Senate

of the Bill in respect of the said amendment.

amend various Acts, as a result of the enactment of the Student

Assistance (Youth Training Allowance) Amendment Act 1994, and

acquaints the Senate that the House of Representatives has considered

the message of the Senate requesting the House to make certain

amendments in such Bill.

The House of Representatives has made requested amendments Nos. 1, 2,

3, 4, 5, 6, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21 and

22; and has not made requested amendment No. 7, but in place thereof

has made the amendment as indicated by the annexed schedule.

The House of Representatives desires the reconsideration by the Senate

of the Bill in respect of the said amendment.

SCHEDULE OF THE AMENDMENT REQUESTED BY THE SENATE

NOT MADE BY THE HOUSE OF REPRESENTATIVES,

BUT BILL AMENDED IN PLACE THEREOF

No. 8--Clause 18, page 219, proposed Schedule 1, subclause 2(11), omit

the subclause, substitute the following subclause:

Living away from home

"(11) A person is independent if that person:

(a) does not live, and for a continuous period of at least 18

weeks has not lived, at a home of the parents, or of a parent,

of the person; and

(b) has, at a time when the person was not living at such a home:

(i) been employed for at least 20 hours per week; or

(ii) been registered by the Commonwealth Employment Service in

an allowance category as being unemployed;

for the period of, or for periods that total, at least 13 weeks;

and

(c) does not receive regular financial support from a parent of the

person.".

REQUESTED AMENDMENT NOT MADE, BUT, IN PLACE THEREOF,

THE FOLLOWING AMENDMENT MADE

Clause 18, page 219, proposed Schedule 1, omit proposed subclause 2(11),

substitute the following subclause:

Living away from home for 18 weeks

"(11) A person is independent if the person:

(a) does not live, and for a continuous period of at least 18 weeks

has not lived, at a home of the parents, or of a parent, of the

person; and

(b) has, at a time when the person was not living at such a home

been employed for at least 20 hours a week for the period of, or

for periods that total, at least 13 weeks; and

(c) is not receiving financial support from either or both of his or

her parents, or from someone else who is acting as his or her

guardian, and did not receive such support during the period

referred to in paragraph (a).".

Senator Schacht moved--That in respect of the Student Assistance (Youth

Training Allowance) Amendment Bill 1994, the committee does not press

its request for amendment no. 8, and agrees to the amendment made by the

House of Representatives in place thereof.

Senator Schacht moved--That in respect of the Student Assistance (Youth

Training Allowance--Transitional Provisions and Consequential

Amendments)Bill 1994, the committee does not press its request for

amendment no. 7, and agrees to the amendment made by the House of

Representatives in place thereof.

Resolutions to be reported.

The Acting Deputy President (Senator West) resumed the Chair and the

Chairman of Committees (Senator Crichton-Browne) reported that the

committee had considered messages nos 435 and 436 from the House of

Representatives relating to the Student Assistance (Youth Training

Allowance) Amendment Bill 1994 and the Student Assistance (Youth

Training Allowance--Transitional Provisions and Consequential

Amendments) Bill 1994 and had resolved not to press its requests for

amendments not made by the House of Representatives and had agreed to

the amendments made by the House of Representatives in place thereof.

On the motion of Senator Schacht the report from the committee was

adopted and the bills read a third time.
