AUSTRALIAN POSTAL CORPORATION AMENDMENT BILL 1994

Order of the day read for the adjourned debate on the motion of the

Minister for Immigration and Ethnic Affairs (Senator Bolkus)--That this

bill be now read a second time.

On the motion of the Minister for Industry, Science and Technology

(Senator Cook) the following amendments, taken together by leave, were

agreed to:

Clause 2, page 2, subclause (1), line 2, omit "subsections (2), (3) and

(4)", substitute "subsection (2)".

Clause 2, page 2, subclauses (3) and (4), lines 6 to 11, omit the

subclauses.

Clause 2, as amended, agreed to.

Clauses 3 to 7, taken together by leave, agreed to.

Clause 8--

Senator Ferguson moved the following amendment:

Clause 8, page 3, at end of clause, add the following subclause:

"(2) Section 27 of the Principal Act is amended by adding the

following word and paragraph after paragraph (4)(b):

"; and (c) that all households to which a roadside delivery service

is available have that service available at least twice

each week'.".

Debate ensued.

Senator Ferguson moved the following amendments together by leave:

Clause 11, page 5, paragraph (d), lines 1 to 15, omit the paragraph,

substitute the following paragraphs:

"(d) by omitting paragraphs (1)(b) and (c) and substituting the

following paragraphs:

"(b) the carriage of a letter relating to goods (including any

newspaper, magazine, catalogue or book) that is sent and

delivered with the goods;

(c) the carriage of newspapers, magazines, books, catalogues and

leaflets which do not convey a unique message or information

other that in the name, address or salutation;';".

Clause 11, pages 5 and 6, paragraph (k), proposed subsection 30(1A),

line 34 (page 5) to line 13 (page 6), omit the subsection.

Debate ensued.

On the motion of Senator Bourne the following amendments, taken together

by leave, were debated and agreed to:

Clause 11, page 5, paragraph (d), lines 1 to 15, omit the paragraph,

substitute the following paragraph:

"(d) by omitting paragraph (1)(c) and substituting the following

paragraph:

"(c) the carriage of a newspaper, magazine, book, catalogue or

leaflet, whether or not directed to a particular person or

address and whether or not enclosed in any sort of cover;';".

Clause 11, pages 5 and 6, paragraph (k), proposed subsection 30(1A) and

examples 1 to 3, line 34 (page 5) to line 13 (page 6), omit the

subsection and the examples.

Clause 11, page 7, paragraph (l), lines 8 to 13, omit the paragraph.

Senator Ferguson moved the following amendment:

Clause 11, page 5, after paragraph (g), insert the following paragraph:

"(ga) by inserting after subparagraph (1)(h)(ii) the following word

and subparagraph:

"or (iii) a service centre of a document exchange service;';".

Senator Ferguson moved the following amendment:

Clause 11, page 6, paragraph (k), proposed subparagraph 30(1B)(c)(vi),

line 34, omit the subparagraph, substitute the following subparagraphs:

"(vi) any other unincorporated body; or

(vii) a group of bodies, whether the bodies are incorporated or not,

that:

(A) are related bodies corporate within the meaning of the

Corporations Act 1989; or

(B) have a common board of management; or

(C) carry on business or conduct operations under the same or

substantially the same group name; and".
