Explanatory memorandum: The Minister for Health (Senator

Richardson)tabled a supplementary explanatory memorandum relating to the

Government amendments to be moved to the bill.

On the motion of Senator Richardson the following amendments, taken

together by leave, were agreed to:

Clause 15, page 15, proposed subsection 65SA(1), lines 20 and 21, omit

"commercial rates", substitute "the rate determined by the regulations".

Clause 16, page 15, proposed subsection 65SB(1), line 40, omit "at

commercial rates", substitute ", at the rate determined by the

regulations,".

Bill, as amended, agreed to.

HEALTH LEGISLATION (PROFESSIONAL SERVICES REVIEW) AMENDMENT BILL 1993--

Bill taken as a whole by leave.

Explanatory memorandum: The Minister for Health (Senator

Richardson)tabled a supplementary explanatory memorandum relating to the

Government amendments to be moved to the bill.

On the motion of Senator Richardson the following amendments, taken

together by leave, were debated and agreed to:

Clause 2, page 1, line 7, omit "31 March 1994", substitute "1 July

1994".

Clause 6, page 5, proposed subsection 84(3), line 27, omit "may",

substitute "must".

Clause 6, page 6, proposed subsection 85(2), line 1, omit "12",

substitute "15".

Clause 6, page 6, proposed subsection 85(3), line 3, omit "may",

substitute "must".

Clause 6, page 6, proposed subsection 86(4), line 28, omit "31 March

1994", substitute "1 July 1994".

Clause 6, page 9, proposed subsection 95(2), line 29, omit "other Panel

members referred to in paragraph (1)(b)", substitute "Chairperson, and

the other Panel members referred to in paragraph (1)(b),".

Clause 6, page 20, proposed subsection 106P(1), line 30, omit "may",

substitute "must".

Senator Lees moved the following amendment:

Clause 6, page 5, proposed subsection 83(2), lines 21 and 22, omit the

subsection.

Debate ensued.

Question--That the amendment be agreed to--put and negatived.

Senator Lees moved the following amendments together by leave:

Schedule, page 36, after proposed amendment to subsection 108(1), insert

the following amendment:

"Subsection 108(2):

Omit the subsection, substitute:

"(2) A Tribunal shall consist of a President and three other members,

who shall be appointed in accordance with this section.'.".

Schedule, page 36, after proposed subsection 108(4A), add the following

subsection:

""(4B) Before appointing a consumer representative to be one of the

other members of the Tribunal, the Minister must consult such

organisations and associations representing the interests of the

consumers of health services, as the Minister thinks appropriate.".

Question--That the amendments be agreed to--put and negatived.

On the motion of Senator Lees the following amendment was debated and

agreed to:

Schedule, page 36, proposed subsection 108(4), omit "The Minister may

make", substitute "The Minister must make".

Bill, as amended, agreed to.

NURSING HOME CHARGE (IMPOSITION) BILL 1993--

Bill, taken as a whole by leave, agreed to.

The National Health Amendment Bill (No. 3) 1993 and the Health

Legislation (Professional Services Review) Amendment Bill 1993 to be

reported with amendments and the Nursing Home Charge (Imposition) Bill

1993 to be reported without requests for amendments.

The Acting Deputy President (Senator Colston) resumed the Chair and the

Chairman of Committees (Senator Crichton-Browne) reported accordingly.

On the motion of Senator Richardson the report from the committee was

adopted and the bills read a third time.
