Senator NASH (New South WalesDeputy Leader of The Nationals in the Senate and Minister for Rural Health) (18:40): The first comments that you made, Senator Xenophon, certainly would be taken into account. It is very important that we do recognise, as you queried, that this is discretionary. Clearly, it is difficult for hard and fast markers, if you like, in this when you are looking at a case and that is why there is a discretion to look at these instances. It is very important to note that it is also subject to full review by the AAT.
