Senator HARRADINE(9.30 a.m.) —I like this motion of Senator Lees's. It is beautifully drafted. It is a procedural motion which is now within the competence of the Senate to consider—it probably always has been, but has only been used rarely. As a matter of fact, I was going to vote for this motion as it was proposed yesterday for the simple reason that it was going to delay the consideration of the bill till the next day of sitting, but last night that apparently changed after the whips' meeting.


The PRESIDENT —Order! The half hour for the debate to this stage has expired.


Senator O'Chee —Madam President, I rise on a point of order. For the benefit of the Senate, pursuant to standing orders, could we have the question currently before the Senate read, please?


The PRESIDENT —Is it the wish of the Senate that the motion before the chamber be read?


Honourable senators —Yes.

The motion reads as follows—

(1)   That so much of standing orders be suspended as would prevent the succeeding provisions of this order having effect.

(2)   That the Telstra (Dilution of Public Ownership) Bill 1996 be divided into two bills as follows:

   (a)   a Bill for an Act to amend the Telstra Corporation Act 1991 to provide for the dilution of public ownership of Telstra; and

   (b)   a Bill for an Act to amend the Telecommunications Act 1991 to provide for a customer service guarantee, and for related purposes.

(3)   That the first bill consist of the enacting words, clauses 1, 2 and 3, the heading "Schedule 1—Amendments", the heading "Telstra Corporation Act 1991 " on page 11, and items 20 to 27 inclusive of Schedule 1 of the original bill, except for proposed Part 2C of the Telstra Corporation Act 1991 in item 24 of Schedule 1 of the original bill (page 47 (line 22) to page 48 (line 23)); and that the second bill consist of the heading "Telecommunications Act 1991 " on page 3, items 1 to 19 inclusive of Schedule 1 of the original bill, and proposed Part 2C of the Telstra Corporation Act 1991 in item 24 of Schedule 1 of the original bill (page 47 (line 22) to page 48 (line 23)).

(4)   That the following amendments be made to the first bill:

   (a)   title, amend the title as shown in paragraph (2)(a) of this order;

   (b)   clause 2, page 1 (lines 8 and 9), omit subclause (1), substitute:

      "(1)   Subject to this section, this Act commences on the day on which:

      (a)   it receives the Royal Assent; or

      (b)   the Telecommunications Amendment (Customer Service Guarantee) Act 1996 receives the Royal Assent;

         whichever is the later." ; and

      (c)   renumber the items in Schedule 1.

(5)   That the following amendments be made to the second bill:

      (a)   after the title, insert the words of enactment;

      (b)   after the words of enactment, insert the following clauses and heading:

"1 Short title

This Act may be cited as the Telecommunications Amendment (Customer Service Guarantee) Act 1996 .

2 Commencement

This Act commences on the day on which it receives the Royal Assent.

3 Schedule(s)

Each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.

Schedule 1—Amendments ";

      (c)   after item 19 of Schedule 1 and before proposed Part 2C of the Telstra Corporation Act 1991 , insert the following heading, item number, item heading and instruction:

      " Telstra Corporation Act 1991

20 After Part 2

Insert:";

      (d)   in the heading to proposed Part 2C of the Telstra Corporation Act 1991 , change "2C" to "2A"; and

      (e)   title, the title to be as shown in paragraph (2)(b) of this order.

(6)   That the bills as amended by this order be printed.

(7)   That further consideration of the bills be an order of the day and be called on immediately.
