Senator HERRON (Minister for Aboriginal and Torres Strait Islander Affairs)(5.56 p.m.) —I have been advised by my legal advisers, having read the Crimes Act, that a penalty unit is a fine of $100. On the other hand, it is certainly the case that a reference to only a term of imprisonment does not prevent a court from applying a fine. But confusion may have arisen and therefore the need for clarification because we are talking about Commonwealth jurisdiction. There is variation in interpretation in states. That may clarify the position for you.
