Senator ALSTON (Deputy Leader of the Opposition) (3.08 p.m.) —That is precisely the position that pertained under the old clause 57. There is that conflict of interest where he assists in the drafting of an application which he is then required to judge as to whether it is frivolous or vexatious. Clearly, he will not. All the minister can say is, `That's all right, but the tribunal could do it later'. What is the point of giving him that discretion at that stage when he will clearly be in a position of conflict?
