Senator TAMBLING (2.43 p.m.) —I am concerned that Senator Evans seems to be implying that the guardian in determining these cases will have to be the state or territory governments. That will always cast them in the role of the seeming opponent. I am certainly aware that whenever the Northern Territory government has had to take that particular role with regard to testing Aboriginal claims under the Aboriginal Land Rights Act it has always been painted into the picture, when it seeks to represent a community view or a community interest, as therefore being the ogre who is at all times seeking to oppose any Aboriginal claimant. I ask the minister what sort of guidelines and systems will be provided to the tribunal to ensure that all determinations will be objective, will in fact test the bona fides and will not result in unscrupulous or spurious claims being made.
