Senator COLLINS (Minister for Transport and Communications) (9.24 a.m.) —Senator Panizza is absolutely correct, he is entitled to that explanation. As I said, it is actually quite clear in the explanatory memoranda on page 29 in respect of 49(3). What it says in respect of Senator Panizza's inquiry is this:

If the native title act involves the grant of an interest which can be granted over ordinary title land, such as a mining interest . . .

I am sure that this is a particular concern of Senator Panizza's—

. . . subclause (3) provides that compensation is to be assessed under the same regime as that for the holders of ordinary title. This is the exception to the entitlement to just terms compensation.

That is the explanation of the similar compensable interest phrase in 49(3) that Senator Panizza is seeking.
