Senator ALSTON (Deputy Leader of the Opposition) (12.01 a.m.) —There are five amendments before the chair. In relation to government amendment 20, the Minister for Foreign Affairs (Senator Gareth Evans) gave fencing off as an example of the type of act that might be covered by the amendment. In a situation where land had been fenced off 50 or 100 years ago, would the mere fact of fencing off, however long ago it might have been, constitute exclusion? I ask the minister what else would need to be shown, given that he says that one would need to demonstrate a continuing association with the land. Surely the mere fact that land was fenced off at some time in the past is not sufficient.
