Senator MINCHIN (11.10 p.m.) —One thing concerns me a little about this clause. As the minister has been saying, if native title is extinguished, it is extinguished and that is the end of the story. But here we have a fairly significant exception where in fact it is not extinguished. The minister has been assuring us that pre-1975 pastoral leases extinguish native title, that pastoralists can operate on that basis and that, if it is extinguished, it is extinguished. But all of a sudden we find that in these cases it is in fact not extinguished. Is it the government's overt intention—it may well be—to go beyond the High Court judgment in providing in this way for Aboriginals who have pastoral leases to resurrect native title? If so, why?
