Senator GARETH EVANS (Minister for Foreign Affairs) (9.22 p.m.) —The provisions in clause 28 only apply if there is no exemption from the process granted under clause 41. These are the provisions that will apply in the absence of that kind of agreement that the state regime can continue to apply in all its glory. As I have indicated, there is a natural bias towards using the state machinery and the state law governing this matter, provided that certain basic provisions are satisfied.

  These should not be read as implying a determination on the part of the Commonwealth to relentlessly apply its own regime. We would be delighted to operate, as far as is humanly possible, within those state regimes. We do not envisage any great difficulty in negotiating the appropriate arrangements once this legislation is passed.
