Senator GARETH EVANS (Minister for Foreign Affairs) (8.20 p.m.) —In no comparable situation that I can think of would non-Aboriginal claimants or litigants be exposed to a penalty. The penalty of being struck out is penalty enough in these circumstances. That is certainly true so far as the conduct of litigation is concerned. That is probably the closest parallel to what is involved here. It would be a pretty innovative provision to go down that path and one that I would think would be perceived as draconian in the extreme. The government is not interested in doing that.
