Senator ALSTON (Deputy Leader of the Opposition) (6.00 p.m.) —I take the Minister for Foreign Affairs (Senator Gareth Evans) to say that it is exclusive, unless one can prove the basis for a determination. If it is right that the interests of justice require it, presumably there is no time limit on that either. So a claimant could come along some years later and say, `The interests of justice require a variation'. We may have already paid out money and proceeded on a certain basis, yet someone could come along and say, `Well, I'm afraid I was not aware of any of this; our group lived elsewhere and we have now come back' and there will be a very valid claim before us.
