Senator GARETH EVANS (Minister for Foreign Affairs) (4.00 p.m.) —That will be made clearer when we get to clauses 56 and 57, which deal with this and will be the subject of some amendments which have been circulated. Already there are grounds for striking out frivolous and vexatious claims and so on. There are threshold criteria that have to be satisfied before a person can be registered. There will be a further provision moved whereby a person can seek the right to strike out before a presidential member—that is, a judicial member of the tribunal—in situations where no prima facie right can be established. From the point of view of people worried about vexatious claims being made—which would be a practical inhibition to these sorts of developments—and people being forced into negotiations in frivolous situations, we have covered that pretty well, but we will debate it further when we get to it.
