Senator GARETH EVANS (Minister for Foreign Affairs) (2.43 p.m.) —Again, confirming my understanding of this, if they are properly described as or limited to a right to mine—sometimes they will be and sometimes they will not—they come within the framework of the requirement of negotiation. If they are not part of the mining interest as such, as defined in the legislation, the right to negotiate does not arise. But there are many different kinds of proprietary right or interest that can be involved vis a vis native title, and the capacity of the native titleholders to enforce a right to negotiation or anything else depends on the kind of right it is.
