Senator GARETH EVANS (Minister for Foreign Affairs) (5.49 p.m.) —The answer to that question is in the explanatory memorandum. I will read what I have. The intention of this technical amendment is to make it clear that the law referred to in that subparagraph does not provide for compensation to native titleholders. The bill gives compensation rights to native titleholders where, under the current law, those rights are available to ordinary titleholders. It becomes a little clearer if one looks at the parent provision. Clause 22(4)(b)(iii) says:

the law mentioned in section 225 . . . does not provide for compensation for the act;

It does not provide for compensation to native titleholders; it clarifies what kind of law is being referred to. The clause is a purely technical improvement that was suggested by the Office of Parliamentary Counsel or someone, because the way in which it was drafted was thought to be slightly less than clear. No content change is involved.
