Senator O'CHEE (9.31 p.m.) —I note Senator Sherry's statement that there are some tests that would be applied. Perhaps he would be kind enough to advise the Senate what those tests are.

Senator Sherry —You would match the two particular criteria that I have outlined against the facts.

Senator O'CHEE —I do not really think that explains what Senator Sherry said about the tests. Senator Sherry seemed to indicate that there were a couple of objective criteria. He is outlining some fairly subjective things. He said that to particularise his earlier generalisation. I am hoping that Senator Sherry might be able to tell us what the particular tests are, or are we in the same uncertain situation that we were before? Whilst Senator Sherry is giving that some consideration, can he advise whether there will be a different criteria applied to a kindergarten or preschool run by the same establishment as is applied to the junior or senior school?
