Senator CRANE (10.28 a.m.) —The minister has identified clause 170DF(2), which states:

Subsection (1) does not prevent a matter referred to in paragraph (1)(e) from being a reason for terminating employment if the reason is based on the inherent requirements of the particular position.

Subsection (e) states:

race, colour, sex, marital status, family responsibilities, pregnancy, religion, political opinion, national extraction or social origin—

and I presume this will be amended in due course if we continue to include sexual preference.

  Could the minister give us a precise definition of what `the inherent requirements of the particular position' means. He is basing his argument on those words and I believe that from what he has said so far, that argument is flawed.
