Senator RICHARDSON (Minister for Health) (5.28 p.m.) —By way of explanation—I suggest that it is imperfect, but it is the best we can do—counsel's opinion was that there was a risk that we might be in strife and no more than that. Therefore, I think it is true to say that we thought we were on solid ground. When this matter went to the High Court, it was a 4-3 decision, which suggests that we must have had some basis for our opinion but that we were overruled by a majority. I cannot do better than that.
