Senator CHAMARETTE —I give notice that, on the next day of sitting, I shall move:

  That the Senate—

    (a)notes:

    (i)the Federal Court order handed down by Mr Justice Neave on 13 August 1993 releasing Jie Xin Tang on the grounds that he had been detained longer than the 273 days allowed for by the Migration Act amendments passed by the Senate in May 1992, and

    (ii)that the other 26 people who arrived on the boat Isabella in December 1991 have subsequently been released by the Department of Immigration until such time as the department wins an appeal against the decision; and

    (b)calls on the Government to:

    (i)withdraw its appeal against the decision of Mr Justice Neave, and

    (ii)immediately release all the remaining `boat people' being detained around Australia and grant residency on humanitarian grounds to those who have been detained for long periods of time.
