Senator SCHACHT —On 10 May, Senator Chamarette asked me a question without notice on exploration and mining of resources in or near the Ningaloo Marine Park and I undertook to provide further information. The Minister for the Environment, Sport and Territories, Mrs Kelly, has provided the following supplementary reply. The legislation listed in the previous answer as being applicable in certain circumstances in relation to oil exploration or drilling in waters administered by Western Australia in or near Ningaloo Marine Park could only be applied if a decision by a Commonwealth Minister or agency became necessary. The proposed activity does not seem to be in an area of direct Commonwealth responsibility and there appears at present to be no requirement for a Commonwealth decision that would trigger Commonwealth legislation. These are the points that were made in the ABC radio interview to which Senator Chamarette refers.
