Senator LEES (Deputy Leader of the Australian Democrats) (1.41 a.m.) —by leave—I move:

6.Clause 41, page 16, subclause (5), line 35, omit "Imprisonment for 6 months", substitute "$250".

7.Clause 41, page 16, subclause (6), line 39, omit "Imprisonment for 12 months", substitute "$1,000".

8.Clause 42, page 17, subclause (5), line 25, omit "Imprisonment for 6 months", substitute "$250".

9.Clause 42, page 17, subclause (6), line 29, omit "Imprisonment for 12 months", substitute "$1,000".

14.Clause 54, page 23, subclause (7), line 10, omit "Imprisonment for 6 months", substitute "$250".

15.Clause 54, page 23, subclause (8), line 14, omit "Imprisonment for 12 months", substitute "$1,000".

I briefly explain that these amendments are related to penalties for not complying with directions to provide information; in other words, for things like not sending back forms on time. The penalties are draconian at six months imprisonment and 12 months imprisonment for not providing information or providing misleading information respectively. We believe that they are ridiculously harsh for the offences they represent and the amendments seek to reduce the penalties to $250 and $1,000 respectively.
