Senator SPINDLER (10.47 p.m.) —May I also briefly address the amendment moved by Senator Harradine. I will support the amendment. I believe the due parliamentary process needs to be observed at all times, even if a Bill is rushed through at the last minute—and perhaps even more so in that case. This is particularly the case with a Bill that proposes to vary the legal rights for a particular class of persons on Australian soil going before Australian courts—people who are to be denied their rights to challenge in court the amount of damages if they are found to have been unlawfully detained, and only in that case. I believe that that is a principle that needs examination before this chamber votes on it. It should not be determined in the hurry in which we are asked to do so tonight. Hence we will be supporting Senator Harradine's amendment.
