Senator COLLINS (Minister for Transport and Communications) (6.13 p.m.) —I move:

After clause 7, page 3, insert the following clauses:

  "7D. After section 123 of the Principal Act the following section is inserted:

Review by the ABA

  `123A.(1) The ABA must periodically conduct a review of the operation of subsection 234(3A) to see whether that subsection is in accordance with prevailing community standards.

  `(2) If, after conducting such a review, the ABA concludes that that subsection is not in accordance with prevailing community standards, the ABA must recommend to the Minister appropriate amendments to the Act that would ensure that that subsection is in accordance with prevailing community standards.

  `(3) If the Minister receives a recommendation under subsection (2), the Minister must cause a copy of the recommendation to be tabled in each House of the Parliament within 15 sitting days of that House after receiving the recommendation.'.".

The purpose of this amendment is simply to indicate that the Australian Broadcasting Authority—I welcome the points made by Senator Walters and Senator Harradine that it is the appropriate authority to do this—should periodically conduct a review of the operation of these new provisions to see whether they are in accordance with prevailing community standards and that it should report regularly. Senator Alston's suggestion regarding subsection (3) was to cause a copy of these recommendations to be tabled in the Parliament `within 15 sitting days of that House after receiving the recommendation'. The Government is perfectly happy to accept that suggestion and we have incorporated it in this amendment.
